The defendant was tried for murder, and convicted of manslaughter, and was sentenced to ten years at hard labor, and he has appealed.
An affidavit was made against him in the First city criminal court, charging him with the crime of which he Has'now been convicted. That court had jurisdiction only to commit, bail or discharge. Before any Hearing had been had on the affidavit, the grand jury found an indictment against him in the criminal district court — the court having jurisdiction to try and punish — and the First city criminal court dismissed the affidavit, over His objection, he insisting…
