Information for poisoning colts. Plea, not guilty. Trial by jury at the September Term, 1903, Bennington County, Watson, J., presiding. Verdict, guilty; and judgment thereon. The evidence that Sargood had furnished intoxicating liquor to' Blair was inadmissible, as was also- the evidence that, after the colts were poisoned, Sargood attempted to- poison Hicks and his wife.

/The respondents were charged-; .with having killed with poison two colts belonging to a neighbor y^They were tried together and convicted and the case is here upon exceptions taken during the course of the trial.

Upon the part of the State a story was developed substantially as follows p/In the small village of Bast Arlington lived Sanford Hicks and his wife, occupying a house upon the street.
