Appeal from an order of the Supreme Court (Kavanagh, J.), entered June 25, 2001 in Ulster County, which granted plaintiffs motion to appoint a Referee in an action to foreclose mortgages on real property.

To provide financing for a family-owned farm corporation, plaintiff loaned funds through the Farmers Home Administration to defendant James S. Lyons (hereinafter Lyons) and his then wife, defendant Elena M. Lyons (hereinafter defendant).
