Appeal from a judgment of the County Court of Chemung County (Danaher, Jr., J.), rendered November 19, 1984, convicting defendant upon her plea of guilty of the crime of manslaughter in the first degree.
*1007On the morning of May 13, 1984, Elmira City Police Officer Charles Patterson responded to a reported disturbance at the Beecher School playground. Upon arrival, Patterson observed Danny Ross being chased out of the school parking lot by defendant, who was swinging a pickax.
