Smythe against the Inhabitants of the Township of New Providence in the County of Union and State of New Jersey. Judgment for plaintiff for an insufficient, amount (253 Fed. 824), and both parties bring error.

The facts which form the background of the matters here assigned as error are briefly these:
This suit was brought upon five bonds issued by the Township of New Providence pursuant to an Act of the Legislature of the State of New Jersey entitled “An Act to authorize certain towns in the Counties of Somerset, Morris, Essex and Union to issue bonds, and take stock in the Passaic and Peapack Railway Company,” approved April 9, 1868 (P.
