JACKSON, Justice.

The appellee, Southwestern Lloyds, a Texas corporation, instituted this suit against the-appellant, the city of Wheeler, a municipal corporation, on six sewer equipment warrants dated May 7,1930, each in the principal sum of $500, and bearing interest at the rate of 6 per cent, per annum.

The appellee alleged that the warrants were issued and delivered by the city to the Sanitary Appliance Company, Inc., pursuant to a contract of date May 7, 1930, by the terms of which the city purchased from' said-company certain patented Sanitary appliances, which are fully described; that…
