Plaintiffs, the Communist Party of Illinois, several of its candidates for state office in the November 5, 1974 general election, and a registered voter desiring to vote for these candidates, filed suit for declaratory and injunctive relief against the State Board of Election Commissioners for the State of Illinois 1 seeking to challenge the constitutionality of a section of the Illinois Election Code, Ill.Rev.Stat. ch. 46, § 10-2.
