The plaintiff1 appeals from the denial of his motion to open the judgment. The action underlying this appeal sought to set aside a real estate conveyance on the ground that the defendant procured the deed by fraud. Because the trial court, Cioffi, J., ren*5dered a disciplinary judgment of dismissal against the plaintiff, it did not reach the merits of the case. The trial court, Lewis, J., denied the plaintiffs motion to open the judgment, and thereafter affirmed the denial of the motion to open after hearing arguments by both parties pursuant to the plaintiffs motion to reargue.
