On the 27th day of September, 1881, an information was filed in the district court of Brown county,, charging the defendant and one Grant Harrington with an assault with intent to kill. Upon the trial Grant Harrington was acquitted, defendant found guilty of assault and bat*765tery, and sentenced to pay a fine of $100 and costs. From this sentence he brings his appeal to this court.
