Thomas C. Trail was indicted in the circuit court of Putnam county for the murder of Peter Bowles and convicted of *176murder in the second degree and sentenced to the penitentiary for the period of six years.

Upon the trial defendant by counsel took five bills of exceptions numbered 1 to 5 respectively. Bill of exceptions No. 1 includes all the evidence taken in the case; No. 2 calls in question the instructions given for the State; No. 3 goes to the refusal of the instructions offered by the defendant; and No. 4, which is made the subject of the first assignment of error in…
