Defendant, John Ray Henry, was charged by information with theft of a motor vehicle and possession of a stolen motor vehicle. After a bench trial, the trial judge found defendant guilty of both offenses. Defendant was sentenced to three years’ imprisonment on the possession offense, the theft offense having merged into that offense. He appeals.

The evidence at trial revealed that defendant took a 1979 Cadillac from the parking lot of a 7-11 store at 106th and Cicero in Oak Lawn, Illinois, on March 5, 1986. The owner of the car had left it with its engine running. Defendant was identified by…
