MEMORANDUM OPINION AND ORDER

This action is the product of competition between two rival cable television corporations to obtain a non-exclusive franchise to provide cable television service to the citizens of Hopkinsville, Kentucky. On December 15, 1981, the Hopkinsville City Council voted to .award a cable television franchise to defendant Pennyroyal Cablevision, Inc.
