MEMORANDUM OPINION AND ORDER

This civil action is before the Court on plaintiff Malibu Boats, LLC’s Motion for a Preliminary Injunction [Doc. 8], in which plaintiff seeks a preliminary injunction pursuant to Rule 65(a) prohibiting defendant Nautique Boat Company, Inc. from manufacturing, marketing, or offering boats for sale that are equipped with Nau-tique Surf System (“NSS”).
