Appeal by the defendant, the' Hoffman House of Hew York, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 24th day of January, 1899, upon the report of a referee, and also from an order bearing date the 18th day of January, 1899, and entered in said clerk’s office, denying the defendant’s motion for a return of the said report.to the referee for amendment.

An action having been commenced by the Farmers’ Loan and Trust Company as trustee against the Hoffman House, a Hew Jersey corporation, to foreclose certain mortgages covering leases and chattels belonging to the defendant therein and which were in the possession of this defendant, and with and upon which it was carrying on a hotel and café business in the city of Hew York, on the 21st of December, 1893, an order was made appointing Edward S.
