GLADDEN, J.,

— Defendant, Oliver Shoemaker, has filed preliminary objections in the nature of a demurrer to plaintiff’s complaint in trespass setting forth an immunity from liability under The Pennsylvania Workmen’s Compensation Act of June 2, 1915, P.L. 736, as amended, 77 P.S. §1 et seq. Defendant, RCA Corporation, has filed an answer with new matter and denies, inter aha, that plaintiff was at the time of the alleged incident its employe.
