Plaintiff, an inspector for the city of Chicago Building Department, filed a two-count complaint seeking damages for injuries sustained when he fell at a construction site. The complaint alleged that defendants were guilty of violations of the Illinois Structural Work Act (Ill. Rev. Stat. 1973, ch . 48, par. 60 etseq.) (the Act) and common law negligence. Defendants’ motion for summary judgment on count I of the complaint dealing with the Act was granted, but the trial court denied the motion as to count II, the negligence count.
