OPINION OF THE COURT

BICKLEY, C. J.

Wesley Stewart was indicted for the murder of G. I. Maloy, which is alleged to have occurred on August 21, 1921.

At the first trial of the cause, defendant was convicted of murder in the second degree and appealed. The judgment in the trial court was reversed and the cause remanded for a new trial. On the Second trial, the defendant was again convicted of murder in the second degree, and it is from this conviction that he appeals.
