The answer alleged that plaintiff’s claim had been settled for $350 and she had received the money in the year 1914. The case was tried before Steele, J., who when plaintiff rested granted defendant’s motion to dismiss the action as to G. W. Plaintiff was struck and injured by an automobile belonging to defendant, Ole Torrison, and driven by one of his employees. About two months thereafter she made a settlement with him by which she received $350 and released and discharged him from all liability for ot on account of the injuries sustained.
