MEMORANDUM OPINION ON PLAINTIFF’S MOTION FOR SUMMARY JUDGMENT

The above-captioned Adversary proceedings each relate to the involuntary bankruptcy case filed on May 12,1993, by creditors of Michael J. Randy (“Debtor”) under Chapter 7 of the United States Bankruptcy Code, 11 U.S.C. ¶ 101 et seq. (“Code”). An order for relief was entered therein on June 17, 1993, and Philip V.
