This action was commenced in December, 1945, to recover the balance claimed to be due upon a promis sory note executed by P. B. Brannon and his wife on January 2, 1922, wherein they agreed to pay one year after date to G. C. Wolfe the sum of $2,245.00, with interest from date at the rate of seven per cent. The payee died on December 1, 1945, leaving a will in which he appointed his widow, Billie C. Wolfe, as executrix and made her the sole beneficiary of his estate.
