Plaintiffs, Chris and Marcia Warrington (“the Warringtons”), brought this action pursuant to G.L.c. 40A, §17 against defendants seeking to annul a decision by the Town of Rutland Zoning Board of Appeals ("the Board”) which granted a Cease and Desist Order (“the Order”) against them. Defendant, Clealand B. Blair (“Blair”), petitioned the Board pursuant to G.L.c. 40A, §7 to issue the Order because plaintiffs’ non-conforming use of their property was in violation of the town’s zoning by-laws.
