This bill in equity was brought to restrain the defendant from discharging into or depositing in a stream flowing through the defendant city above the plaintiff’s property any refuse material, sewage, gravel and other debris, to compel it so to use the water of the stream as not to injure the plaintiff in his occupation and enjoyment of his property, for the assessment of damages and other relief.
