CHASE, Circuit Judge.

This appeal is from an interlocutory decree of the District Court for the Western District of New York which held valid and infringed claims 1, 9, 10, and 11 of Patent No. 1,924,082, granted on August 28, 1933, to the plaintiff as the assignee of Edward L. Barrett, who filed his application as the inventor on January 3, 1933. The patent is for motor actuated circuit controlling means designed to interrupt the current flowing in an electrical circuit by' alternately making and breaking the circuit in rapid succession.
