WOLFE, Justice.

This is an appeal by Isadore Eisen, one of the defendants below, from a judgment obtained against him by the respondents, Albert P. Neilson, and his wife, Eileen W. Neilson, plaintiffs below, in the sum of $8500, with interest at the rate of eight per cent per annum from April 1, 1947, plus $500 attorney fees and costs. A judgment of no cause of action was entered in favor of the other defendant, Freda Eisen. From the latter judgment no appeal has been taken, and consequently, Freda is not a party to this appeal.
