Marvin R. Mathis (Mathis) sued Christopher Eilers, Sr., and Jr., the owners of a Cessna airplane, George C. Ruth (Ruth), the pilot, and Atlantic Aircraft Distributors, Inc., (Atlantic), the lessees of a portion of Harbor Field, an airport located on the southeastern edge of Baltimore City near the Broening Highway, to recover for injuries sustained by him when he was struck by the rotating propeller of the airplane as it was “taxiing” on a paved apron area at the airport.
