This is a class action challenging several aspects of the Minnesota Department of Public Welfare’s treatment of “lump-sum” income in administering the jointly funded federal-state Aid to Families with Dependent Children (AFDC) program established by the Social Security Act, 42 U:S.C. § 601 et seq. The defendant, Leonard Levine, who was sued in his capacity as Commissioner of the Minnesota Department of Public Welfare (DPW), raises two issues on appeal: whether the District Court1 erred in holding that the defendant failed to give advance notice of its changed lump-sum…
