In this action involving the alleged misuse of a labor union’s funds, the defendants, prior to joinder of issue, move to dismiss the complaint. The plaintiffs cross-move for partial summary judgment. The plaintiffs are members of Local 420 American Federation of State, County and Municipal Employees and the defendants are three of its officers.
