These are consolidated appeals arising out of a wrongful death and survival action brought by Burnice L. Barnum, as administratrix of the estate of her uncle Jimmy L. Barnum, against Coastal Health Services, Inc. In Case No. A07A1562, Coastal Health appeals from the trial court’s denial of its motion for summary judgment based on the affirmative defense of accord and satisfaction.
