Certifying the Law.
The appellee, Bobert Barton, castrated a boar belonging to Langston Durberry. The boar died and Barton was indicted under section 1249 of the Kentucky Statutes, which reads as follows:
“If any person shall unlawfully kill, disfigure, injure, maim, poison or attempt to administer poison to any cat-*466tie not his own, he shall he fined not less than ten nor more than one thousand dollars, or imprisoned not less than one nor more than twelve months, or both so fined, and imprisoned.”
