January 4, 1937, Harry G. Liebhardt and Edith Liebhardt, then husband and wife, entered into a separation agreement under the terms of which the husband was to pay the wife $450 a month so long as she lived, provided, however, that if at any future time the parties were divorced and the wife remarried such payments were to be discontinued. The following day Mrs. Liebhardt filed a divorce complaint in the district court of the City and County of Denver, and on August 19, 1937, the interlocutory decree of divorce entered February 18, 1937, was made final.
