OPINION

BRETT, Judge:

Appellant, Roger Stevenson, hereinafter referred to as defendant, was convicted in *1198the District Court of Comanche County, Case No. CRF-72-321, for the offense of Unlawful Delivery of Controlled Drug, Phencyclidine, and sentenced to ten (10) years imprisonment and a fine of three thousand dollars ($3,000). Judgment and sentence was imposed on October 13, 1972, and this appeal perfected therefrom.
