Affirming.
At the time of the transactions involved herein, sections 2833 and 2839 of the 1930 Edition of Carroll’s Kentucky Statutes, both of which are parts of the charter of cities of the first class, constituted the governing’ law with reference to improvements of streets, alleys, ways, etc., in cities of that class.
