Appeal from a judgment of the County Court of Montgomery County (Catena, J.), rendered September 7, 2007, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.

Defendant pleaded guilty to a superior court information charging him with burglary in the third degree. During defendant’s plea allocution, he stated that he had entered his estranged wife’s residence, despite the fact that he did not have permission to do so.
