Appeal from a judgment of the County Court of Cortland County (Campbell, J.), rendered May 11, 2006, convicting defendant upon his plea of guilty of the crime of attempted rape in the first degree.
In December 2005, defendant was indicted on a charge of rape in the first degree. He pleaded guilty to attempted rape in the first degree and waived his right to appeal in exchange for a sentence of five years in prison and five years of postrelease supervision.
