—Plaintiffs claim title to the property in controversy through a" patent of the United States issued to J. J.. Warner, January 16, 1880, pursuant to the provisions of the act of Congress of March 3, 1851, entitled “An act to ascertain and settle the private land claims in the state of California.” Defendants claim a possessory right as mission or pueblo Indians, and by their answers form three groups, describing severalty the tracts of land alleged to be occupied by them, the first consisting of nineteen hundred and seven acres; the second, two hundred and sixty-six and forty-three…
