I am writing in response to your request for my opinion on the following questions:

1. Can a city buy a building with Hotel, Motel Restaurant funds ["hamburger tax"1 funds] and the Advertising and Promotion ("AP") Commission administer the building? Is a lease required for such an arrangement?
