1Opinion of the CourtStone, J.
The plaintiff in error was convicted of murder in the second degree under the statute, or upon a verdict not indicating that the killing was premeditated so as to involve the death penalty, and was accordingly sentenced to the penitentiary for life. Some of the questions raised by the assignment of errors are similar to the principal questions presented in the case of Jones *211v. The People, 6 Colo. 452. As to those questions, the decision in the case referred to obviates the necessity for extended discussion here.
