The plaintiff in error was jointly indicted with Lloyd TI. Lemser and Guy Golden upon the charge of grand larceny and receiving stolen property. Lemser was acquitted and both Golden and the plaintiff in error were convicted, their punishment being 'fixed at five years in the penitentiary. Ripley alone has appealed and assigned errors.
