ALPERT, Judge.

At trial of this worker’s compensation appeal, counsel for John Tomillo, appellee, made the following statement during his closing argument.

I think there is good news and bad news for Mr. Tomillo and I do not say this flippantly. The good news is that the law in this country is overwhelmingly on his side; the bad side is that the Maryland Court of Appeals ha[s] never directly had the issue before it.
