J. E. Work, Inc., was awarded a construction contract for a part of the Randle-Yakima highway with the United States Bureau of Public Roads, Department of Commerce. On December 21, 1962, R. H. Lovell and Evan D. LaRue, partners, doing business as the Olympic Construction Company, were awarded a subcontract to perform some of the bid items of the prime contract. The subcontractor was to be paid the full unit price of the bid items it contracted to perform. The subcontractor’s performance bond was furnished by Fidelity & Deposit Company of Maryland.
