This case has been brought to this coñrt by a writ of ei’ror from,the Circuit Court of the United States for the district of Massachusetts.

It is an action for money had and-received. It was sued out hy the plaintiffs against the-defendant, the collector of customs for the port of Boston, to recover the sum of $14,206.10, with the interest thereon, which the plaintiffs allege was illegally exacted from them by the defendant in his official character, and which was paid by them under protest, as the law permits that to be done.
