The defendant, David Anthony Davies, was convicted by a jury of the crime of placing an explosive substance against or near a building with *21intent to destroy or injure it. MCLA § 750.206 (Stat Ann 1962 Rev § 28.403).
A store located on the northeast corner of Puritan and Freeland in Detroit was damaged hy an explosion sometime between 10:30 and 11 p.m. on June 16, 1969.
