Defendant appeals his conviction of the crime of burglary after a trial by jury. He was sentenced to a term of not less than three nor more than five years in the penitentiary.

Initial consideration must be given to defendant’s argument that the trial court committed error in overruling his motion to quash the indictment. His motion was founded upon the premise that fatal prejudice resulted when the statute relating to the selection of a grand jury was violated by the State’s Attorney being present at and participating in the selection of the grand jurors who returned the indictment against…
