This action stems from damages the Plaintiffs insured, Kraft Foods International, Inc., incurred after Panamanian port inspectors quarantined and blocked the entry of multiple containers of food products because of mold contamination. Thereafter, all Kraft food products in the containers were destroyed. As the cargo insurer for Kraft Foods International, Inc., Plaintiff seeks to hold Defendant liable for its provision of pallets with an allegedly excessive moisture content based on claims of breach of warranties (Count I) and negligence (Count II).
