Appeal from a judgment of the County Court of Warren County (Hall Jr., J.), rendered December 4, 2015, convicting defendant upon his plea of guilty of the crime of assault in the second degree.

Defendant waived indictment and entered an Alford plea of guilty to assault in the second degree as charged in a superior court information. The charge was brought after defendant’s three-month-old infant was found to have sustained brain injuries consistent with nonaccidental trauma. The injuries required multiple surgeries and resulted in brain damage, developmental delays, seizures and blindness.…
