This criminal proceeding commenced with the filing of an accusatory instrument on April 10, 2000. Defendant was charged with two misdemeanors: (i) assault in the third degree, in violation of section 120.00 (1) of the Penal Law, and (ii) operating a *149motor vehicle while under the influence of alcohol, in violation of section 1192 (2) of the Vehicle and Traffic Law. Defendant also was charged with a traffic infraction relating to her operation of a motor vehicle while her ability to do so allegedly was impaired. (See Vehicle and Traffic Law § 1192 [1].)…
