GOODMAN, District Judge.

This is an action pursuant to Section 70, sub. e of the Bankruptcy Act, 11 U.S. C.A. § 110, sub. e by the Trustee of the estate of a bankrupt William Jason Evans, doing business as Evans Construction Company. The Trustee seeks to recover from the defendant Bank of America $20,300 collected by the Bank as assignee of the payments to become due the Evans Construction Company under a contract with the State of California for the construction of a bridge. The assignment to the Bank was made on September 15, 1948, to secure loans to be made by the Bank to Evans Construction…
