This matter is before the Court on Defendant York School Department's ("the School Department") Motion to Dismiss under Fed. R. Civ. P. 12(b)(6) for failure to state a claim upon which relief can be granted (ECF No. 9 ). The School Department seeks dismissal of all three counts asserted against it in the complaint by Plaintiffs Michael and Erin McCann ("the *137McCanns"),1 on behalf of their minor son, J.M.
