Defendant in this proceeding was found guilty by Alderman Raymond Sohl, acting for the Mayor of the City of York, of violating section 4 of an ordinance of the city enacted under date of August 24, 1934, prohibiting disorderly conduct within the city. The maximum fine of $300 was imposed. From this conviction an appeal was taken. *471Certain stipulations of counsel were made a matter of record and a motion to dismiss the proceeding was made by counsel. We are now urged to sustain the appeal for the reasons that the City of York had no lawful authority to pass penal legislation…
