The landlord instituted this proceeding at the behest of the Police Department of the City of New York pursuant to section 52 (subd. 4) of the State Rent and Eviction Regulations of the Temporary State Housing Rent Commission and section 1410 (subd. 5) of the Civil Practice Act, on the ground that the tenant is using the premises for illegal purposes, “ in violation of section 976 of the Penal Law.” Section 976 of the Penal Law, so far as applicable to the facts herein, reads as follows: 1 ‘ Removal of tenants using premises for game of policy.
